Dilapidation Claims

The terms Dilapidations is normally used to cover defects which Tenants will be required to deal with – or pay to have remedied – when vacating a leasehold property.

We can prepare and serve a landlords schedule of dilapidations on the outgoing tenant and if necessary, ensure the repair works are carried out in accordance with the lease or to negotiate and agree on costs involved to undertake the repairs.

Should the repairs not be undertaken by the tenant we are able to quantify the loss suffered and prepare a claim against the tenant. If required we are able to produce schedule of works/tender documents and obtain competitive quotations from contractors to undertake repair works to support the landlord’s claim.

We are able to act for tenants in connection with a schedule of dilapidations served by the landlord commenting on the validity of the items claimed under the terms of the lease and whether the costs are reasonable. We are able to provide a view on the landlord’s claim and provide a strategy for negotiating the claim and assist with implementing necessary repairs to mitigate the claim.
